Can insurance companies over charge for subpar insurance?
The Court affirmed the trial court judgment to respondent State Farm and its agent, John Mallet, finding that the respondents did not owe a duty, either expressed or implied, to sell the homeowners the best policy at the lowest available price. Thus, the respondents were not liable for allowing the homeowners to purchase standard flood insurance policies when preferred risk policies were available at a lower cost.
